Impact statement: This article examines the rapid growth of identity theft in the context of modern communication technologies and argues that existing Australian laws were piecemeal and too limited to address newer internet driven forms of identity crime. It is important because it analyzes the techniques used by offenders, the losses suffered by victims, and the weaknesses of the legal framework, while also drawing on reform discussions in the United Kingdom and Canada. By arguing for a specific identity theft offence and supportive legal measures, the article contributes to stronger criminal law responses to evolving technology enabled fraud.
