Impact statement: This article examines the gaps in Australian law governing unauthorized access to wireless local area networks and shows that the legal framework clearly covers hacking and denial of service attacks but leaves significant uncertainty around practices such as wardriving, joyriding, ISP liability, and access in public places. It is important because it connects evolving wireless technologies with the need for clearer and more effective legal rules. By identifying these uncertainties and arguing for stronger legal certainty, the article contributes to scholarship on cybercrime, communications regulation, and technology-sensitive law reform.
