| Impact statement: The line between interpreting and making the law by the judiciary is often a controversial one. While the former would, in one way or the other, often transform into the latter, reasonable minds can differ when such an exercise is indispensable or otherwise. Taking a functional approach, this chapter critically engages with the reported cases of the Supreme Court of Bangladesh (SCB).
